长江流域环境司法管辖制度的转型与重构

On Transformation and Reconstruction of the Environmental Judicial Jurisdiction System in the Yangtze River Basin

长江流域在我国经济发展与环境保护中具有重要战略地位,传统行政区划下碎片化的环境司法管辖模式难以为流域整体性保护提供统一的司法保障。综合环境案件跨区域管辖实践情况,长江流域形成了环境司法管辖模式多元化、审判模式类型化以及受案范围复杂化的环境司法管辖格局。环境案件存在跨区域管辖依据不足、管辖模式混乱、受案范围界定难以及与其他机关衔接配合存在障碍等问题。对此,可通过补足跨区域管辖依据、统一环境司法管辖模式、明确受案范围以及加强与其他机关的衔接配合等方面完善长江流域环境司法管辖制度,实现长江流域生态环境一体化保护。

The Yangtze River basin has an important strategic position in the economic development and environmental protection,the fragmented mode of environmental judicial jurisdiction under the traditional administrative division is difficult to provide unified judicial protection for the integrity of the basin.Considering the practice of cross⁃regional jurisdiction of environmental cases,the Yangtze River Basin has formed a pattern of environmental judicial jurisdiction with diversified models,typi⁃fied trial models and complicated scope of accepting cases.There are some problems in environmental cases,such as lack of cross⁃regional jurisdiction basis,confusion of jurisdiction mode,difficulty in de⁃fining the scope of accepting cases and obstacles in connecting with other authorities.Therefore,the en⁃vironmental judicial jurisdiction system of the Yangtze River basin is improved by supplementing the cross-regional jurisdiction basis,unifying the mode of environmental judicial jurisdiction,clarifying the scope of accepting cases and strengthening the connection and coordination with other organs,so as to realize the integrated protection of its ecological environment.
