Research on the Patent Protection of Graphic User Interface(GUI) Design

【目的】通过对GUI外观设计专利侵权案件的对比分析,找出GUI外观设计专利制度存在的不足,并提出相关完善建议。【方法】通过分析相关案件,梳理司法审判中GUI外观设计专利侵权的侵权判定规则。【结果】由于GUI外观设计的特殊性,可以通过细化侵权判断的主体、简化“产品”对GUI外观设计的限制、引入间接侵权规则等方式扩大对GUI外观设计专利的保护。【结论】随着科技发展,GUI外观设计未来会有更多形式呈现,因此需要在立法及司法中对GUI外观设计保护加以完善。

[Purposes] Through a comparative analysis of GUI design patent infringement cases,this paper finds out the shortcomings of the protection system for GUI design patents,raise issues and puts forward relevant suggestions for improvement.[Methods] By analyzing relevant cases,this paper sorts out the infringement judgment rules for GUI design patent infringement in judicial trials.[Findings] Due to the particularity of GUI appearance design,the protection of GUI appearance design patents can be expanded by refining the subject of infringement judgment,reducing the limitations of "products" on GUI appearance design and introducing indirect infringement rules.[Conclusions] With the development of science and technology,there will be more forms of GUI appearance design in the future,so it is necessary to perfect the protection of GUI appearance design in legislation and judicature.
