罪错未成年人分级处遇的实践问题与完善路径

The Practical Problem and the Perfect Way of Graded Intervention for Juvenile Delinquents

结合我国刑事司法实践的需求,继续完善罪错未成年人分级处遇体系将是一项重要且需长期执行的工作。就我国罪错未成年人分级处遇的现状而言,目前仍然存在主导力量缺乏、配套实施细则缺位、处遇层级区分不完善、分级矫治效果有限等问题。因此,有必要在儿童利益最大化、教育保护、调查先行、责任个别化和可恢复性五项指导原则的基础上,建设专门的罪错未成年人分级处遇工作队伍、细化分级处遇的必经程序和判断标准以及推动处遇措施的专门化。

Combined with the needs of China’s criminal justice practice,it will be an important and long-term work to continue to improve the system of graded intervention for juvenile delinquents.As far as the current situation of the graded intervention of juvenile delinquents in China is concerned,there are still some problems,such as the lack of dominant force,the absence of supporting implementing rules,the imper‐fect division of the level,the imperfect distinction of treatment levels,the limited effect of graded correction and so on.Therefore,on the basis of the five guiding principles of maximizing children’s interests,educa‐tion protection,investigation first,individualization of responsibility and recoverability,it is necessary to build a special working team for the graded intervention of juvenile delinquents,refine the necessary proce‐dures and judgment standards for graded intervention,and promote the specialization of intervention mea‐sures.
