论中华法系的传承与中国自主法学知识体系的建构

On the Inheritance of Chinese Legal System and the Construction of China’s Independent Knowledge System of Legal Science

新时代中国法治建设事业的推进需要建构一套中国自主法学知识体系,而这一知识体系的自主性需要发掘中华优秀传统法律文化的资源。中华法系是中华优秀传统法律文化的象征和载体,其中蕴含的丰富的历史遗产是当下中国自主法学知识体系建构的宝贵资源。中国古代的各种法哲学流派,作为法律思想源流构成了引领法律学术发展变化的世界观;中国古代立法学成果,表现为悠久的法典化历史传统;作为中国古代法律人的律家对立法、执法、司法、法律学术与教育的信念与奉献,显示出宝贵的精神财富——律家精神。对中华法系历史遗产的传承是要在中国法治现代化的历史语境之下进行,对知识体系的内容应当进行甄别,对其中所承载的优秀传统法律文化予以继承并在马克思主义的指导下内化于我国法治建设的实践中,实现“创造性转化”与“创新性发展”。

In the new era,the promotion of the construction of the rule of law in China needs to construct a set of China’s Independent knowledge system of legal science.The knowledge system needs to explore the resources of Chinese excellent traditional legal culture.The Chinese legal system is the symbol and carrier of Chinese excellent traditional legal culture,and the rich historical heritage contained in it is a valuable resource for the construction of China’s independent legal knowledge system.The various schools of legal philosophy in ancient China,as the guiding ideology of law,constitute the world outlook leading the development and change of legal science;the achievements of legislation in ancient China are manifested in the long historical tradition of codification;the belief and dedication of lawyers in legislation,law enforcement,judicature,legal science and education show the precious spiritual wealth-the spirit of lawyers.The inheritance of the historical heritage of the Chinese legal system should be carried out in the historical context of the modernization of the rule of law in China,and the content of the knowledge system should be screened,and the excellent traditional legal culture carried by it should be inherited and internalized in the practice of the construction of the rule of law in China under the guidance of Marxism,so as to realize“creative transformation”and“innovative development”.
