The Theory and Practical Logic of Active Judiciary in the New Era

新时代新征程的能动司法不是既往能动司法的翻版,而是具有深刻的理论和实践逻辑:一是,能动司法是新时代坚持党的全面领导之政治逻辑使然,是坚持党对司法的领导的重要表现,是加强和改善党的领导、提高党执政能力和执政水平、巩固党长期执政地位的现实需要。二是,能动司法是新时代以人民为中心发展理念的司法镜像,不仅可以保障人民的诉讼权益、促进矛盾纠纷的实质性化解,而且能够有效回应人民群众的正义需求。三是,能动司法是对中国式现代化时代主题的法治回应,不仅能够应对中国式现代化发展新变化、接纳现代化发展新成果,而且可以促进国家治理体系和治理能力现代化。四是,新时代能动司法创造中华司法文明新形态,延续了“法理情融合”的中华司法文明传统,传承了“马锡五审判方式”等司法文明,弘扬了“人民司法”的崇高理念,以尊重人权、维护公正、定分止争、促进和谐、保障发展、服务大局,创造性实践开辟了人类司法文明新境界。

The active judiciary of the new era and new journey is not a replica of the previous active judiciary,but has profound theoretical and practical logic:firstly,active judiciary is the result of the political logic of upholding the Party's overall leadership in the new era,an important manifestation of adherence to the Party's judicial leadership,and a practi-cal need to strengthen and improve the Party's leadership,improve the Party's governance ability and level,and consoli-date the Party's long-term governance position.Secondly,active judiciary is the judicial reflection of the people-cen-tered development concept in the new era.It can not only protect the people's litigation rights and promote the substantive resolution of conflicts and disputes,but also effectively respond to the just emotions of the people.Thirdly,active judiciary is the legal response to the theme of the times of Chinese modernization.It can not only respond to new changes in the de-velopment of Chinese path to modernization and accept new achievements of modernization development,but also promote the modernization of national governance system and governance capacity.Fourthly,active judiciary creates a new form of Chinese judicial civilization,continuing the traditional Chinese judicial civilization of"the integration of reason and law",inheriting judicial civilization samples such as the"Ma Xiwu Trial Methods",promoting the noble concept of"people's justice",and opening up a new realm of human judicial civilization through creative practice of respecting human rights,safeguarding fairness,resolving disputes,promoting harmony,ensuring development,and serving the overall situation.
