AI绘画是AI技术与人类主体互相作用的产物,它一方面彰显着人类主体意识,另一方面展现出审美属性,是人类创造的最新艺术形态。作为艺术,AI绘画作品具有无可争议的产权,但这种产权的归属有待立法明晰,综合考量将AI绘画作品的产权赋予AI用户更有利于AI绘画产业的可持续发展。较比传统绘画,AI绘画具有创作数量和创作效率上的巨大优势;反之,传统绘画具有原创性和艺术风格上的天然优势,两者应扬长避短,协调发展。

AI paintings,a product of the interaction between AI technology and human beings,demonstrate a sense of human subjectivity and aesthetic attributes.It is the latest art form created by human beings.As art,AI paintings undoubtedly have property rights,but the ownership of such property rights needs to be clarified by legislation.Upon comprehensive consideration,property rights of AI paintings should be granted to AI users,which will be more conducive to the sound and sustainable development of the AI painting industry.Compared with traditional paintings,AI paintings boast huge advantages in amount and efficiency;however,traditional paintings have natural advantages in originality and artistic style.The two should leverage their strengths,avoid weaknesses and develop in a coordinated manner.
