摘要
虽然ChatGPT等人工智能的创作突破了作品作者须是自然人的限定,但考虑到借由版权法奖励劳动、鼓励社会对话、激励科学和艺术的发展以及促进知识产权的功利目的,可以将“含有思想或情感内容”的作品判断标准加以缓和,赋予ChatGPT等人工智能生成物以可版权性。至于ChatGPT等人工智能生成物的著作权归属,需要结合我国相关法律的立法目标、经济发展、ChatGPT等人工智能的法律地位等因素,于当下和未来选择不同的路径。《生成式人工智能服务管理暂行办法》首次在部委规章层面,提出了生成式人工智能服务的系统法律规制方案。立法者应当以此为起点,与时俱进跟上科学技术发展的脚步,接受重塑版权法的挑战,制定新的知识产权法律框架。
ChatGPT and other Artificial Intelligence tools use algorithms,data and computing power to create works,breaking the limitation that the creator must be a natural person.However,copyright law seeks to reward labor,encourage social dialogue,encourage the development of science and arts,and promote the utilitarian purposes of intellectual property.Based on utilitarian considerations,the criterion for judging works that"contain thought or emotional content"can be softened when granting copyrights to AI products such as ChatGPT.As to the copyright ownership of AI products such as ChatGPT,the legislative goals of the Copyright Law,economic development,and the legal status of AI such as ChatGPT,different schemes to be chosen at present and in the future should be considered.Provisional Measures for the Administration of Generative Artificial Intelligence Services for the first time put forward a systematic legal regulation scheme for generative Artificial Intelligence services at the level of ministerial regulations.On this basis,lawmakers should keep pace with the speed of scientific and technological development,accept the challenge of reshaping Copyright Law,and formulate a new intellectual property legal framework.
