Throughout the history of human development,under certain historical conditions heavy punish-ment and torture have played an important role in maintaining class rule and social stability.However,with the development of human civilization to a higher level,the leniency of modern punishment has become an inevita-ble choice in history,which is also a reasonable choice in the tide of international penal reform and develop-ment.Through the analysis of the penalty system of Yuan Dynasty,we can see that the judicial idea of using the punishment of livestock to offset the penalty and reduce the death penalty is in line with the value orienta-tion of modern punishment leniency law.The application of these tolerance will well reflect the harmonious con-cept of the criminal justice in our country,and realize the judicial harmony and social harmony.Therefore,fur-ther consideration of the tolerance of the penalty system in Yuan Dynasty will positively influence the establish-ment of the modern criminal policy of tempering justice with mercy in our country.
