数字经济背景下,数据在市场经营活动中的作用更加突出,也使得竞争方式日趋复杂。当前,市场中衍生了一系列新型平台数据垄断形式,不仅破坏公平市场竞争秩序,损害消费者权益,还会阻碍数字经济的创新发展。我国传统反垄断规制思路无法有效应对平台数据垄断行为,存在算法合谋式新型垄断协议认定困难、传统相关市场界定方法适用局限、数据驱动型经营者集中申报标准滞后等现实困境。对此,应尝试优化算法合谋式新型垄断协议的认定方式,改进相关市场界定分析方法,构建多元化经营者集中申报标准,以加强我国平台数据垄断行为的法律规制。

Under the background of digital economy,data plays a more prominent role in market operation activities,which also makes the competition mode increasingly complex.At present,a series of new forms of platform data monopoly have been derived in the market,which not only undermines the fair market competition order,damages the rights and interests of consumers,but also hinders the innovative development of the digital economy.China's traditional anti-monopoly regulation ideas cannot effectively deal with the platform data monopoly behavior,there are some practical difficulties,such as the difficulty in identifying the new monopoly agreement of algorithm collusion,the limitation of the application of traditional relevant market definition methods,and the lagging centralized reporting standards for data-driven operators.In this regard,we should try to optimize the identification method of the new monopoly agreement of algorithm collusion,improve the relevant market definition and analysis method,and establish centralized reporting standards for diversified operators so as to strengthen the legal regulation of platform data monopoly behavior in China.
