摘要
乡村振兴战略的提出,使得诉源治理从法院减轻诉累的底层依托转型为社会治理的有效手段,并在赋能乡村治理领域作用凸显。基于“无讼”法治文化的价值指引、“枫桥经验”治理经验的有益参考以及法经济学成本效益的权衡,乡村振兴与诉源治理具有进一步融合适用的可行性与必要性。遗憾的是,诉源治理在乡村社会中的实践仍面临诸多不敷适用之处,尤其表现在基层法院参与诉源治理职能失范、非诉解纷主体衔接不畅、乡村诉源治理信息建设滞后等,函待思考。基于此,当前应通过推进诉调对接、调整非诉职能并强化基层法院参与诉源治理职能建设;其次,细化非诉解纷衔接机制;最后,利用算法、大数据等新兴科技赋能乡村诉源治理。
The introduction of the rural revitalization strategy has transformed the bottom-up approach of relying on the courts to alleviate the burden of litigation into an effective means of social governance.It has also played a significant role in empowering rural governance.The integration of the values guided by the"culture of non-litigation"in the rule of law,the beneficial reference of the"Fengqiao Experience"in governance,and the consideration of cost-effectiveness in legal economics provide a feasible and necessary approach to further harmonize rural revitalization and conflict resolution.Unfortunately,the implementation of source governance in rural communities still faces many challenges.These challenges are particularly evident in the deviation of the participation of grassroots courts in source governance,the lack of smooth coordination between non-litigious dispute resolution entities,and the lagging behind in the information construction of rural source governance.These issues require urgent consideration,on which basis we should currently promote the docking of litigation and mediation,adjust non-litigation functions,and strengthen the construction of the grassroots courts'participation in the governance of litigation sources.Secondly,we should refine the mechanism for linking non-litigation disputes.Lastly,we should utilize emerging technologies such as algorithms and big data to empower the governance of litigation sources in rural areas.
