摘要
本文论述了新就业形态下“不完全符合确立劳动关系情形”的概念性质、法律适用、发展历程、相关政策和国内外发展概况,总结了“不完全符合确立劳动关系情形”面临的主要问题,包括劳动法律制度存在短板、职业伤害保障不足、利益诉求表达渠道不畅通、平台算法还需进一步优化。结合我国实际情况,从以下方面提出“不完全符合确立劳动关系情形”的规制路径:一是妥善处理政府与市场、企业与劳动者的关系;二是健全劳动法律政策保护体系;三是使新就业形态劳动者入会,通过工会组织畅通维权渠道;四是完善行业自律机制,引导企业承担社会责任。
This report discusses the concept,the nature,the law application,development,related policy and development at home and abroad for"not fully conforming to the situation of establishing labor relations"in the new form of employment,summarizes the main problems of"not fully conform to the establishment of labor relations",including the inadequacy of the labor legal system and occupational injury protection,the obstruction of workers'interest appeal channels,the imperfection of the platform algorithm.According to the actual situation in China,The regulation path of"not fully conforming to the situation of establishing labor relations"is put forward from the following aspects:first,to properly handle the relationship between government and market,between enterprise and laborer;second,to improve the labor law system;third,to join trade unions for workers in new forms of employment and open the channels of rights protection through the trade union organization;fourth,to improve the industry self-discipline mechanism and guide the enterprises to assume social responsibility.
