国际视野下的终身学习权法定化:权利证成与实践路径

摘要 终身学习权是构建终身学习制度的基石,其在教育法治秩序中的明确对于建设学习型社会具有关键性作用。终身学习权法定化已成为全球范围内终身学习实践演进的趋势,从国际视野对其加以分析和论证,有助于我国的终身学习法治建设。从权利证成“三标准”理论来看,终身学习权具备法定化所需的合理性、合法性与现实性:就其合理性而言,利益正当性是合理性之首要标准,终身学习权所涉及的概念、属性、主体、客体与内容中都蕴含着该权利所保护利益的正当性;就其合法性而言,终身学习权被国际组织以及多国的教育战略、政策和法律所承认和尊重,并以直接或间接的方式所容纳,从而具备了该权利存在的社会机制及合法性;就其在我国的现实性而言,习近平法治思想、我国地方性立法实践、教育法典编纂为终身学习权的法定化提供了根本遵循、经验参考和重要契机,使其具备了充分的现实性。因此,我国可通过在教育法典中明确终身学习权的法律地位,构建以终身学习权为核心的权利体系和实施保障体系,实现终身学习权的法定化。 The right to lifelong learning is the cornerstone of building a lifelong learning system,and its clarity in the legal order of education plays a crucial role in building a learning society.The legalization of the right to lifelong learning has become a trend in the evolution of lifelong learning practice worldwide.Analyzing and demonstrating it from an international perspective will contribute to the construction of the rule of law for lifelong learning in China.From the perspective of the“three standards”theory of rights certification,the right to lifelong learning has the rationality,legality and reality required for legalization.In terms of its rationality,the legitimacy of interests is the primary criterion for rationality,and the concepts,attributes,subjects,objects,and contents involved in the right to lifelong learning all contain the legitimacy of the interests protected by the right;In terms of its legitimacy,the right to lifelong learning is recognized and respected,accommodated directly or indirectly,by international organizations and multinational education strategies,policies and laws,thus possessing the social mechanism and legitimacy of its existence;In terms of its practicality in China,Xi Jinping’s Thought on the Rule of Law,local legislative practice,and education code compilation provide fundamental guidance,experiential reference,and important opportunities for the legalization of lifelong learning rights,making it fully realistic.Therefore,China can clarify the legal status of the right to lifelong learning in the Education Code,construct a rights system and implementation guarantee system centered on the right to lifelong learning,and hence to achieve the legalization of the right to lifelong learning.
