技术性证据专门审查的检察监督机制建构

Construction of a Procuratorial Supervision Mechanism for Special Examination of Technical Evidence

由文证审查演变而来的技术性证据审查制度,在提高技术性证据质量、强化检察监督等方面都彰显了巨大的制度优越性。但是,技术性证据专门审查仍然面临着审查意识不足、审查能力欠缺、审查范围以及审查程序模糊等问题,并且随着科技对司法活动的浸润,使得上述问题日益凸显,难以发挥技术性证据审查制度实效。为落实技术性证据审查制度对检察工作的支撑作用,首先,要从其制度本身价值进行剖析,明晰其检察监督职能,以及广泛应用于各种法律监督活动中的可能性;其次,畅通制度配套的机制,明确技术性证据审查制度的启动条件与审查程序,完善以内部前置审查为主、对外委托审查为辅的协作机制,并搭建全过程监督机制以及后续大案要案提前介入的反馈机制。

Having evolved from the examination system for documentary evidence,the examination system for technical evidence has manifested great institutional advantages in improving the quality of technical evidence and strengthening procuratorial supervision.Nonetheless,the special examination for technical evidence still has obvious deficiencies such as insufficient awareness,unqualified capacities,unclear scope and procedures of the examination,etc.Moreover,with the increasing infiltration of science and technology into judicial activities,the above deficiencies are getting more prominent,hampering full play of the effectiveness of this examination system.In order to implement the supporting role of this examination system in procuratorial work,we should first analyze the value of the system itself,clarify its procuratorial supervision functions and its possibility of being widely used in various legal supervision activities.Second,we should ensure the supporting mechanism for the system is unimpeded,clarify the starting conditions and examination procedures for the examination system for technical evidence,improve the collaborative mechanism which is mainly based on internal pre-examination and supplemented by external commissioned examination,and establish a feedback mechanism featured by full-process supervision and early intervention for major cases.
