我国档案行政处罚工作的困境与进路

The Dilemma and the Way Forward of China's Archival Administrative Punishment Work

档案行政处罚是纠正档案违法行为、提高档案治理效能、扎实推进依法行政的重要手段。面对法治国家、法治政府、法治社会一体建设的时代要求,随着档案法规与《行政处罚法》的修订,我国档案行政处罚工作面临行政处罚手段有限、行刑责任衔接不畅、裁量基准亟待统一、缺乏法律文书的制作规范等现实困境,应从完善处罚类型与处罚模式、构建行刑处罚衔接机制、统一档案行政处罚裁量基准、出台《档案行政处罚法律文书制作规范》等方面予以改进。

Archives administrative punishment is an important means to correct illegal acts in archives,improve the efficiency of archives governance,and solidly promote lawful administration.Faced with the requirements of the era of integrating the construction of a rule of law country,a rule of law government,and a rule of law society,with the revision of archival regulations and the Administrative Penalty Law,China's archival administrative punishment work has gradually shown practical difficulties such as limited administrative punishment methods,poor connection of execution responsibilities,urgent need for unified discretion standards,and a lack of standardized production of legal documents.It is necessary to improve the types and modes of punishment,build a administrative and criminal punishment connection mechanism,and Efforts will be made to improve the standardization of administrative penalties for archives and the introduction of the Regulations for the Production of Legal Documents on Administrative Punishment for Archives.
