自由竞争理念下商业贿赂问题的法律治理研究

商业贿赂的竞争法品质决定了自由竞争理念应是治理商业贿赂的重要基础价值。我国传统反商业贿赂模式面临的困境包括:传统的法律监管模式滞后、有权监管商业贿赂的执法机关较多、企业反商业贿赂的积极性不足。原因在于:传统反商业贿赂的立法理念滞后;反商业贿赂的执法制度不够完善;缺乏激发民企反商业贿赂积极性的法律机制。当代反商业贿赂应贯彻自由竞争的价值理念,发挥公私主体协同治理的效能。公主体层面应加快转变政府职能,完善立法层面的认定标准,精简反商业贿赂主管机构。私主体层面应建立符合数字经济时代要求的合规审查制度,建立内部独立审计监督制度,形成保障企业合规审查制度运行的配套机制。形成双向贯通、上下联动的反商业贿赂模式,在维护市场动态竞争的前提下实现商业贿赂问题的有效治理。

The difficulties faced by China’s traditional anti commercial bribery model include:lagging traditional legal supervision model,more law enforcement agencies with the power to regulate commercial bribery,and insufficient enthusiasm of enterprises in anti commercial bribery.The reason is that the legislative concept of traditional anti commercial bribery lags behind;The enforcement system against commercial bribery is not perfect enough;Lack of legal mechanisms to stimulate the enthusiasm of private enterprises in combating commercial bribery.Contemporary anti commercial bribery should implement the value concept of free competition and leverage the effectiveness of collaborative governance between public and private entities.At the princess level,it is necessary to accelerate the transformation of government functions,improve the recognition standards at the legislative level,and streamline the regulatory authorities for anti commercial bribery.At the private entity level,establish a compliance review system that meets the requirements of the digital economy era,establish an internal independent audit supervision system,and form a supporting mechanism to ensure the operation of the enterprise compliance review system.
