智慧卫生监督中电子证据运用现况和法律适用构建研究

Research on the Current Use of Electronic Evidence and the Construction of Legal Applicability in Smart Health Supervision

研究卫生监督从传统现场执法转型到数字化、智能化监管过程中,智慧卫生监督中电子证据运用和法律适用构建研究。从国内外电子证据执法运用的现况研究发现,需完善电子设备证据运用的精准性和可采性问题,电子证据在收集保存和传输过程中保护其真实性、完整性和可靠性,个人隐私和数据安全保护问题等。现有卫生监督数字化监管中,已实现减少随机性问题发现、并兼具预警提示作用,但数据收集、转化和有效利用等问题需进一步完善等,有效实现非接触式执法尚有多处难点。因此,智慧卫生监督建设过程中需要进一步完善,包括电子证据在非接触执法中法律适用、流程构建、信息平台建设、预警告知和数据安全等。逐步完善实现卫生监督数字化智能化监管转型,提升卫生监管效能,维护居民健康权益。

This study investigated the transition of health surveillance from traditional on-site enforcement to digital intelligent oversight,focusing on the application of electronic evidence and legal compliance in smart health surveillance.Through examinations of the current state of electronic evidence enforcement both domestically and internationally,issues related to the precision and admissibility of electronic device evidence application,the preservation of authenticity,integrity,and reliability during the collection,storage,and transmission of electronic evidence,as well as concerns regarding personal privacy and data security protection were identified.While existing digitalized health surveillance has proven effective in reducing the occurrence of random issues and providing early warning alerts,there is still room for improvement in aspects such as data collection,conversion,and effective utilization,posing several challenges to achieving non-contact enforcement effectively.Therefore,the development of smart health surveillance must be further enhanced.This includes addressing issues related to the legal application of electronic evidence in non-contact enforcement,process development,information platform construction,early warning notifications,and data security.Gradual improvements in transitioning health surveillance into a digitized and intelligent oversight system will enhance the effectiveness of health regulation while safeguarding the rights and well-being of residents.
