美国在线法律学位教育的发展及启示

On the Development and Implication of Online Law Degree Education in the United States

摘要 虽然美国监管者对在线法律教育态度较为保守,但逐步放开对在线法律教育的限制已是大势所趋,这种变化其动因在于技术进步、法律教育大众化与法学院经济模式变革。通过对美国律师协会、州律协、法院制定的监管规则的分析,可以发现美国对在线法学教育矛盾中向前的态度。美国的发展实践与教训可以为我国法学教育的发展提供启示与借鉴。我国具备开展在线教育的基础设施与法治条件,可以在多校区大学普法、全日制、非全日制和对外教育等方面展开在线法律教育。 Although the U.S.regulators are conservative about online legal education,the gradual ease of restrictions on online legal education is already an irresistible trend which is motivated by the development of technology,the popularization of legal education and the reform of the economic model in law schools.By analyzing the regulatory rules set by the American Bar Association,State Bar Associations,and Courts,it can be revealed that the United States is positive about online legal education in an ambivalent way.The development experience and lessons of the United States can provide inspiration and reference for the development direction of legal education in China,which has the infrastructure and rule of law conditions to carry out online education,for example,China can start online legal education in law popularization of multi-campus university,full-time,part-time,and international education.
