重罪案件认罪认罚从宽制度的适用问题——以权利保障为价值导向

Application of The Leniency System for Admitting Guilt and Accepting Punishment in Felony Cases Vocational Students--Value-Oriented by Rights Protection

目前,轻罪案件适用认罪认罚从宽制度,取得良好效果,但重罪案件受限于该制度所追求的效率价值这一目标,未得到充分适用。缘于制度价值导向失衡、法律规范模糊不清以及各方主体利益难以平衡,重罪案件在适用认罪认罚从宽制度时明显受制。因此应当转换价值导向,注重对当事人特别是被追诉人的司法权利保障,尝试从权利保障角度来探析重罪案件适用认罪认罚从宽制度的路径。最终,立足权利保障的价值导向,确立相关法律规范、构建与强化相应程序的制度,改善重罪案件适用效果差的现状,从而发挥认罪认罚从宽制度的优势。

Nowadays,while the leniency system for admitting guilt and accepting punishment has achieved good results in misdemeanor cases,the felony cases have not been fully applied because of the efficiency value goal pursued by the system.Due to the imbalance in the value orientation of the system,the lack of standardized legal guidance,and the difficulty in balancing the interests of various parties,the application of the leniency system for admitting guilt and accepting punishment in serious crime cases is constrained.Therefore,we should transform the value orientation,pay attention to the protection of the judicial rights of the parties,especially the accused,and try to explore the path of applying the leniency system for admitting guilt and accepting punishment to felony cases from the perspective of rights protection.Currently,based on the value orientation of rights protection,we should establish relevant legal norms,construct and strengthen corresponding procedural systems,so as to improve the current situation of poor application effects in felony cases,and ultimately give full play to the advantages of the leniency system for admitting guilt and accepting punishment.
