摘要
近年来,随着共享经济、平台经济的高速发展,依托于网络平台的外卖配送、货物运输等新就业形态在稳定就业、推动消费等方面发挥着日益重要的作用,但同时也为新就业形态劳动者权益保障带来了现实困难和挑战。在充分考虑我国在该领域的宏观政策、我国地方政府的有益尝试和他国的相关治理经验后,可以总结得出新就业形态劳动者权益保障的“一体化”思路。要建立更具可操作性的新型用工关系认定标准,灵活化改革社会保险缴存制度,打造多渠道多层次的新型劳动关系治理模式,构建起新就业形态劳动者权益保障机制。
Over recent years,emerging forms of employment such as take-out delivery and freight transportation facilitated by online platforms have become crucial in bolstering employment and consumption.Yet,it has concurrently fostered complexities and challenges in safeguarding these workers’rights and interests.By examining China’s macro policies,the effective endeavors of local governments,and related overseas governance experiences,the authors propose the notion of“integration”.This implies the formulation of a clearer standard for identifying new employment relations,the versatile reform of the social insurance contribution system,the innovative creation of a multi-channel and multi-tiered labor relations governance model,and the distinctive advancement of the mechanism for ensuring workers’rights and interests in new employment model.
