摘要
在平台经济背景下,平台劳动者和企业间的用工关系受到去劳动关系化的影响,存在用工主体复杂化、证据收集困难化、劳动关系从属性弱化的特点,这导致我国司法实践中否定劳动者和平台企业间存在劳动关系的情形较为常见。平台企业相较于劳动者处于强势地位,掌握算法制定权,出于维护弱势群体、和谐劳动关系的目的,有必要借鉴域外优秀法治经验,重构劳动关系认定标准,优化举证责任分配,以此破解平台用工模式下的劳动关系认定难题。
In the realm of the platform economy,worker-enterprise employment arrangements often exhibit de-employment characteristics featuring intricate employment entities,evidential difficulties,and weakened work relationships.This disparity has resulted in denial of labor relations in Chinese legal practice.As platform companies hold rights to formulate algorithms,they hold superior power over employees.To protect marginalized groups and reconcile labor relations,trade unions at all levels must adapt legal experiences outside the fi eld,revise labor relation determination standards,optimize burden of proof balance,so as to solve the identification challenges of platform employment.
