摘要
制定一套具备普遍接受度的国有企业规则逐渐成为国际社会的共识。CPTPP的创新之一便是为此设独立章节,并主要通过非歧视待遇和商业考虑、非商业援助、透明度三项核心内容对国有企业加以规制。虽然CPTPP中的国企规则作为国有企业的监管模式存有瑕疵,但它明确了国企定义,以及设置了更高标准的非商业援助和透明度规则。基于对CPTPP国企规则的分析,建议我国从多方面采取应对措施。推进国企改革,减少受规制的国企规模,重视磋商工作,规范补贴监管制度,提升企业自身水平等,以适应CPTPP的规则体系。
There is a growing international consensus to develop a set of generally acceptable rules for SOEs.One of the innovations of the CPTPP is the creation of a separate chapter to regulate SOEs through three core elements:non-discriminatory treatment and commercial considerations,non-commercial assistance,and transparency.Although the SOEs rules of CPTPP have the flaw as a supervision model for SOEs,it clarifies the definition of SOEs and sets higher standards of non-commercial assistance and transparency rules.Based on the analysis of the CPTPP SOEs rules,it is suggested that China should take countermeasures in many aspects.We should promote the reform of SOEs to reduce the scope of regulated SOEs,pay attention to consultation,standardize the regulatory system of subsidies,and improve the level of enterprises themselves,etc.,in order to adapt to the rule system of CPTPP.
