行政法总则中的“党的领导”规范:入法必要性及其展开

The"Party Leadership"Norms in the General Provisions of Administrative Law:The Necessity of Entry into Law and Its Development

“党的领导”入法是党领导国家法治建设衍生出来的中国特色法治实践。行政法总则中写入“党的领导”规范具有必要性,这是由行政法总则需要体现中国制度特色、落实宪法基本原则以及整合现有政制安排所决定的。行政法总则要对“党的领导”进行科学定位,尤其是在新时代党政融合大背景下要对“党的领导”规范进行准确表达:一方面表现为“在行政之先”的领导作用,具体包括党对行政方向的领导、对行政决策的领导和对行政人员的领导;另一个方面包括“在行政之侧”的保证作用,具体包括党对行政独立性的保证、对行政合法性和对行政效率性的保证。对于“党的领导”规范的展开,行政法总则制定过程中既要关照当下的状况,又要为发展预留空间,从而实现党和政之间持续的良性互动。

The entry of"Party Leadership"into law is a rule of law practice with Chinese characteris-tics derived from the construction of national rule of law led by the Party.It is necessary to include"Party Leadership"in the general provisions of Administrative Law,which is determined by the need to reflect the characteristics of the Chinese system,implement the basic principles of the Constitution and integrate the existing political arrangements.The general provisions of Administrative Law should scientifically position"Party Leadership",especially in the context of the integration of the party and the government in the new era,the norms of"Party Leadership"should be accurately expressed:on the one hand,it is manifested as the leading role of"before administration",including the Party's leadership of direction of administration,the leadership of administrative decision-making and the leadership of administrative personnel;the other aspect includes the guarantee function of"on the administrative side",including the Party's guarantee of administrative independence,the guarantee of administrative legitimacy and the guarantee of administrative efficiency.For the development of the norms of"Party Leadership",the formulation of the general provi-sions of Administrative Law should not only take into account the current situation,but also reserve space for development,so as to achieve continuous positive interaction between the Party and the government.
