论环境行政专业性判断的司法审查构造

环境行政专业性判断是行政机关在环境风险规制领域中作出的专业性裁量,难以用传统司法实务上的实体性审查方法和程序性审查方法对其施加法律控制。通过行政机关的理由说明义务履行,法院可以过程性审查方法对环境行政专业性判断在推理环节和论证过程中的重要节点予以检视,以考虑因素与操作方法是否适当来实施司法审查。环境行政专业性判断的审查阶段分为对判断基准和对基准客观适用的二阶层过程性审查,对判断基准的审查重点应放在客观考虑因素和完整裁量逻辑,对判断基准客观适用的审查重点应放在个案中的风险调查和风险评估。

The professional judgment of environmental administration is the professional discretion made by administrative organs in the field of environmental risk regulation,and it cannot be legally con-trolled by traditional judicial entity review methods and procedural review methods.Through the performance of the administrative organ's explanation obligation,the court can examine the important nodes of environ-mental administrative professional judgment in reasoning and argumentation process by process review meth-od,so as to consider whether the factors and operation methods are appropriate for judicial review.The re-view stage of professional judgment of environmental administration is divided into two aspects:the bench-mark of environmental risk judgment and the objective application of the benchmark.The focus of the court's review of the judgment benchmark should be on objective considerations and complete discretion logic,and the focus of the review of the objective application of the judgment benchmark should be on risk investiga-tion and risk evaluation in individual cases.
