总体国家安全观视野下农村老年人邪教犯罪及其治理实证研究

The Cult Crime of the Elderly in Rural Areas from the Perspective of the Overall National Security Concept and the Empirical Study of its Governance

邪教犯罪治理效果关乎社会秩序稳定和公民生命健康安全。总体国家安全观指导下,邪教犯罪治理问题应上升到国家安全的高度加以重视。老年人是农村邪教犯罪的主要群体之一,其产生的传播效应更不容忽视。农村老年人邪教犯罪呈现出文化程度较低的老年女性犯罪占比高、有违法犯罪记录占比高,与家人共同实施散发、传播邪教宣传品占比高、临近居住地实施非组织性邪教活动占比高等特点。邪教传播内容的迷惑性,加之老年人群体自身的被害性、农村邪教传播的便利性、刑罚打击效果的局限性,引发老年人群体从事邪教犯罪。在总体国家安全观指导下,各方力量要完善农村老年人权益保障体系、提升反邪教宣传效果、提高邪教犯罪侦查能力、充分发挥刑罚的教育功能,以此消除犯罪内生因素,切断邪教传播外部条件,真正推动平安乡村建设目标的实现。

The effectiveness of the control of cult crimes has a bearing on the stability of social order and the health and safety of citizens.Guided by the overall concept of national security,this issue should be taken seriously from the perspective of national security.The elderly are one of the main groups of rural cult crimes,and we should pay attention to their spreading effects.Most of the cult crimes committed by the elderly in rural areas are characterized by women with a low level of education,who have criminal records,who jointly distribute and disseminate cult propaganda materials with their family members,and carry out unorganized cult activities close to their places of residence.The confusion of the content of cult propagation,the victimization of the elderly themselves,the convenience of the spread of cults in rural areas,and the limitations of the effect of criminal punishment have caused the elderly groups to engage in cult crimes.Under the guidance of the overall concept of national security,it is necessary to improve the system for protecting the rights and interests of the elderly in rural areas,enhance the effectiveness of anti-cult propaganda,enhance the ability to investigate cult crimes,and give full play to the educational function of criminal punishment,so as to eliminate the endogenous factors of crime,cut off the external conditions for the spread of cults,and truly promote the construction of safe villages.
