论我国网络食品安全的行政回应

On the Administrative Response of Network Food Safety in China

在“互联网+”时代,中国的网络食品安全形势不容乐观。行政的内容和特点决定着其在我国网络食品安全问题治理回应中的主导性地位。治理行政是经由“夜警”行政和规制行政发展出的新范式,网络食品安全的行政回应必须坚持共建共治共享的治理行政理念,由此网络食品经营者、网络食品交易第三方平台和政府监管部门负有不同的公法义务,以形成治理合力。当前,我国网络食品安全行政回应的主导策略仍是传统“全能政府”观念支配下的规制行政,这导致“安全”监管理念共识未能形成、治理行政在组织运行上未能体现和政府监管面临网络技术瓶颈等问题。因此,回归食品安全独立管制制度和重构网络食品安全的行政回应体系是解决上述问题的根本之策。

In the Internet Plus era,China's network food safety situation is not optimistic.The content and characteristics of administration determine its leading position in the governance response of network food safety issues in China.Governance administration is a new paradigm developed through the"night police"administration and regulation administration.The administrative response of network food safety must adhere to the governance administrative concept of co-construction,co-governance and sharing.Therefore,network food operators,third-party platforms for network food trading and government supervision departments have different public law obligations to form a governance synergy.At present,the leading strategy of China's network food safety administrative response is still the regulation administration under the control of the traditional concept of"all-powerful government",which leads to the failure to form a consensus on the concept of"safety"supervision,the failure of governance administration in the organization and operation,and the network technology bottleneck faced by government supervision.Therefore,returning to the independent regulatory system of food safety and reconstructing the administrative response system of network food safety are the fundamental solutions to the above problems.
