随着新一代信息技术产业的兴起,产业内涉及新技术、新应用、新业态的专利申请量也大幅提升,由于该产业中的技术改进常依托于智能算法、计算机程序、互联网等载体,相关专利申请常涉及数据安全、网络安全、智力活动规则与方法等情形,导致容易被认定为不授予专利权的客体。此外,《专利审查指南》也于2023年就该产业的相关专利审查规则做出调整。本文就涉及不授予专利权客体的各个法条在该产业中的常见表现情形进行探讨,从而帮助规避被审定为不授予专利权客体的风险。

With the rise of the new generation of information technology industry,the number of patent applications involving new technologies,new applications and new forms of business in the industry has also increased significantly.Because the technical improvement in the industry often relies on intelligent algorithms,computer programs,the Internet and other carriers,related patent applications often involve data security,network security,rules and methods of intellectual activities and other situations,which lead to the easy identification of objects for which no patent right shall be granted.In addition,GuidelinesforPatent Examination also made adjustments to the relevant patent examination rules for the industry in 2023.This paper discusses the common performance of each article involving the object for which no patent right shall be granted in the industry,so as to help avoid the risk of being authorized as a non-patentable object.
