食品产业外观设计专利现状及相关建议

Current Situation and Related Suggestions of Design Patents in the Food Industry

现代农业与食品产业集群是广东省十大战略性支柱产业集群之一,作为传统产业,其转型升级发展对广东省的经济起到重要基础支撑的作用。本文基于专利数据库对食品产业的外观设计专利进行全面检索,利用专利情报信息分析其国内及广东省内的发展态势,旨在为广东省食品产业的研发及外观设计专利保护提供信息参考。研究表明:把食品列入外观设计专利的保护客体,为食品行业的发展起到尤为关键的作用;近二十年来,我国食品产业的发展迅速,食品产业知识产权保护意识不断提高,广东省在全国范围内也较为领先,但龙头企业的优势不明显,需要进一步加强政策引导,鼓励创意创造。

Modern agriculture and food industry cluster is one of the ten strategic pillar industrial clusters in Guangdong Province.As a traditional industry,its transformation and upgrading play an important role in supporting the economy of Guangdong Province.Based on the patent database,this paper conducted a comprehensive search of design patents in the food industry,and analyzed the development trend in China and Guangdong Province with patent information,aiming to provide references for the research and development of food industry and design patent protection in Guangdong Province.The research showed that the inclusion of food in the protection object of design patent plays a key role in the development of food industry;In the past two decades,China’s food industry has developed rapidly,and the awareness of intellectual property protection in the food industry has been continuously improved.Guangdong Province is relatively leading in the country,but the advantages of leading enterprises are not obvious,and it is necessary to further strengthen policy guidance and encourage creativity and innovation.
