为提高专利文本质量,本文基于技术交底书,从理论与实例两个方面,研究技术方案挖掘与权利要求布局。技术方案挖掘需遵循问题主线,注重对技术方案的创造性分析,重构技术方案集合;在争取权利要求保护范围的前提下,权利要求布局应统筹兼顾权利保护全面性、层次性及侵权取证便利性等。通过研究分析,实现研发成果的全面系统保护,创造高质量、高价值专利。

In order to improve the quality of patent texts,the paper studies technical solution mining and claims layout from two levels of theory and examples based on the invention disclosure.The technical solution mining needs to follow the main line of the problem,pay attention to the creative analysis of technical solution,and reconstruct the collection of technical solution.Under the premise of striving for the scope of claims,the layout of claims should take into account the comprehensiveness,hierarchy and convenience of infringement forensics.Through research and analysis,comprehensive and systematic protection of research and development results will be achieved to create high-quality,high-value patents.
