府际财政应急援助的嵌入式协同治理机制构建

Mechanism of Embedded Collaborative Governance of Intergovernmental Financial Emergency Aid

对口支援作为中国特色的府际财政应急援助机制,是突发事件下府际财政协同治理的重要实践形式。然而,“动员式协同”的府际财政应急援助实践在权责划分以及利益激励等方面还存在一些问题,亟需纳入法治化轨道。嵌入理论为府际财政应急援助提供了更优的模式选择,“嵌入式协同”的府际财政应急援助治理模式在组织形态、制度基础和动力因素方面有其优势,有利于实现纵向上政府由“主导”到“引导”的转型,横向上政府由“被动”到“主动”的转变,构建应急财政权力的新型配置格局。应当基于“结构嵌入(纵向引导与横向协作的有机结合)—规则嵌入(法律体系与互助协议的联合规制)—动力嵌入(权责划分与利益补偿的有效衔接)”的框架构建其相应机制。

As an intergovernmental financial emergency aid mechanism with Chinese characteristics,counterpart support is an important practical form of intergovernmental financial collaborative governance under emergencies.However,the practice of"mobilized coordination"has normative defects in the division of powers and responsibilities,as well as in its benefit incentives,so it is in dire need to be incorporated into the legal track.The embedded governance theory provides a better model choice for intergovernmental financial emergency aid.The governance model of"embedded collaboration"has its advantages in terms of organizational form,institutional basis and dynamic factors,which is conducive to the transformation of vertical government from"leading"to"guiding",and horizontal government from"passive"to"active",to construct a new institutional allocation pattern of emergency fiscal power.The corresponding mechanism should be built based on the framework of"structural embedding(mix of horizontal and vertical coordination in government policies)-rule embedding(mix of hard law governance and soft law governance)-dynamic embedding(effective connection between power and responsibility division and benefit compensation)".
