高度智能化特征下ChatGPT对知识产权保护带来的风险与挑战及其应对策略

摘要 人工智能已成为最新科技前沿的代名词。人类的生产方式和经济结构正在随着人类社会的科技创新而发生深刻变革。近期ChatGPT智能聊天机器人的出现引起了人们广泛关注。它具有代表着人工智能时代到来的通用人工智能大模型、高度智能化、记忆性等特点,同时也带来了知识产权保护方面的新挑战。笔者认为,人工智能快速发展的同时,应高度关注其安全风险挑战,加强前瞻预防,强化知识产权规制与引导,确保人工智能安全、可靠、可控,服务于人类社会良性可持续发展。本文以ChatGPT为切入点,就其对知识产权保护所带来的风险与挑战进行讨论,探讨人工智能带来的知识产权保护的相关问题及其应对策略。 Artificial intelligence has become synonymous with the latest technological frontier.The mode of production and economic structure of human beings are undergoing profound changes with the scientific and technological innovation of human society.The recent appearance of ChatGPT,a smart chatbot,has attracted a lot of attention.It has the characteristics of general artificial intelligence large model,high intelligence and memorability,which represents the arrival of the era of artificial intelligence.At the same time,it also brings new challenges in the intellectual property protection.The author believes that,with the rapid development of artificial intelligence,we should pay close attention to its security risks and challenges,strengthen the proactive prevention,strengthen the intellectual property regulation and guidance,to ensure that the artificial intelligence is safe,reliable and controllable,and serves the benign and sustainable development of human society.Taking ChatGPT as the entry point,this paper discusses the risks and challenges of intellectual property protection brought by ChatGPT,and discusses the related issues and countermeasures of the intellectual property protection brought by the artificial intelligence.
