专利侵权风险管理对后发企业技术赶超的影响研究

The Influence of Patent Infringement Risk Management on Latecomer Enterprises Technological Catch-up

本文以中国后发企业2022—2023两年追踪的调研问卷数据为样本,实证分析专利侵权风险管理对后发企业技术赶超的影响,以及技术创新的中介作用,技术能力、知识产权保护的调节作用。研究发现:专利侵权风险管理正向影响后发企业技术赶超;技术创新在专利侵权风险管理与后发企业技术赶超中发挥部分中介作用,且该作用兼具当期效应与时滞效应;技术能力以及知识产权保护能够显著影响专利侵权风险管理对技术创新的作用。研究结果在考虑内生性问题以及稳健性检验后依然成立,为专利侵权风险管理的创新驱动效应提供实证依据,引导中国后发企业在繁茂的“专利丛林”中砥砺前行。

Based on a tracking survey data of Chinese latecomer enterprises from 2022 to 2023,it explores the impact of patent infringement risk management on latecomer enterprises technological catch-up,as well as the mediating effect of technological innovation and the moderating effect of technical capability and intellectual property protection.According to the analysis,this study got the following conclusions.Firstly,the patent infringement risk management has a positive impact on latecomer enterprises technological catch-up.Secondly,the technological innovation partially mediates the relationship of patent infringement risk management on latecomer enterprises technological catch-up,and the effect is current and time-delaying.Thirdly,both the technical capability and the intellectual property protection moderate the relationship of patent infringement risk management on technological innovation.The results pass the endogenous and robustness test,provide empirical evidences of innovation-driven effect of patent infringement risk management,guide Chinese latecomer enterprises forging ahead in patent thicket.
