On Function Dissimilation and Measure Concurrence of Compulsory Measures to the Object

我国刑事对物强制性措施制度不健全,以证据保全功能定位的对物强制性措施代行财产保全功能,立法和司法实践中发生功能异化现象,反映出实践对财产保全制度的迫切需求,同时,证据保全与财产保全对物强制性措施存在“交叉但不重合”的竞合关系。厘清证据保全与财产保全功能二者的关系,有利于理解实践中查封、扣押、冻结的乱象,更有助于进一步明晰刑事对物强制性措施制度的构建路径。

The system of compulsory measures to the object in criminal proceedings in our country is imperfect.The legislation and judicial practice concerning the function of evidence preservation and property preservation exhibit dissimilarity,highlighting an urgent need for the improvement of the property preservation system.Additionally,there exists a concurrent relationship between evidence preservation and property preservation measures characterized by“crossing but not overlapping”.Clarifying this relationship will help us understand the chaotic phenomenon of sealing up,seizing,and freezing assets in practice,as well as provide guidance for the further development of compulsory measures system in criminal proceedings.
