Registration of the Transference of the Trust Property Ownership of the Real Estate Trust without a Principal

在我国应当将无委托人的不动产信托的受托人登记为作为其信托财产的不动产的所有权人;现存的关于这种不动产信托仍然以其委托人为前述不动产的登记所有权人的情形需要改变。要致使《中国信托法》能够为我国政府不动产登记机构办理前述登记提供民事实体法依据,需要将下述两项规定中的某一项增补入该法中:一项是以“无委托人的信托的信托财产权转归受托人享有”为其内容的规定,另一项是以“无委托人的信托的信托财产权置于受托人的名义之下”为其内容的规定。有可能在我国确立的只能够适用于这种不动产信托的不动产信托登记制度,应当考虑将与其适用对象相适应的下述两项规定纳入其中:第一项是记载不动产信托预先登记规则的规定,第二项是关于其适用能够将这种不动产信托的受托人置于由法律作为其信托财产的不动产设定的义务的承担者的地位的规定。

The trustee of the real estate trust without a principal in our country should be registered as the owner of such real estate;the existing ownership of such real estate is still registered as the owner of the aforesaid real estate and needs to be changed.If China Trust Law can provide the basis for the substantial civil law for the real estate registration authorities of the Chinese government in managing the aforesaid registration,one of the following two provisions needs to be added to the law:one being“the trust property of the real estate trust without a principal should be transferred to the trustee”;the other being“the trust property of the real estate trust without a principal should be in the name of the trustee”.It is possible that what has been confirmed in our country can be applied only in the aforesaid registration,but the following two provisions should be included in the system for the suitable objects:one being the provision of recording the real estate trust in the advance registration;the other being the provision about its application that puts such trustee as the undertaker of the duties stipulated by the law for the real estate trust.
