论社会源废弃口罩处置制度的构建完善

On the construction and improvement of the disposal system of waste masks from social source

在新冠肺炎疫情暴发期间,口罩在这个时候对于公民生命安全的保护发挥了重大作用,因此对于口罩的应用性研究也随之增多,正是由于在口罩相关方面研究的增多,才注意到对社会源废弃口罩相关法律法规的缺乏。在构建完善的社会源废弃口罩处置制度过程中,虽然我国在此方面有不少概括性的法律法规、制度规章,但仍然缺乏具体性的规定。因此,本文从明确、清晰社会源废弃口罩性质定义、统一社会源废弃口罩处置制度规范以及具体规定不同情况下社会源废弃口罩处置后果的法律责任三个方面构建完善社会源废弃口罩处置制度。

During the outbreak of the COVID-19 pandemic,masks played a significant role in protecting citizens'lives.With increased research on mask applications,the lack of specific legal regulations regarding the disposal of socially sourced disposable masks became apparent.In the process of constructing and improving the disposal system for socially sourced disposable masks,while there are many general laws,regulations,and institutional rules in China regarding this matter,specific provisions are still lacking.Therefore,this paper aims to establish a comprehensive system for the disposal of socially sourced masks,focusing on three aspects:clearly defining the nature of masks discarded by the general public,standardizing the disposal system for such masks,and specifying the legal responsibilities for mask disposal under different circumstances.
