Y2K法律问题之研究

一、前言。公元2000年信息年序错乱问题,我国有不同的称呼,例如“公元2000年信息危机”“千禧年电脑危机”“软件危机”以及“Y2K危机”,“电脑2000年问题”“2000年问题”“千年虫问题”以及“Y2K问题”等,本文从俗以“Y2K危机”称之。Y2K之危机,主要起因于公元20世纪60年代及70年代电脑设备价值极其高昂,应用尚未普及,那时电脑硬件设计及电脑程序撰写者为求节省数据域位占内存之储存空间,就“时序”在电脑软硬件设备之构成设计上,只存记年、月、日之后两位,亦即将年、月、日各以两位数方式显示。

Before the Year 2000,there are numerous relevant disputes arising from Y2K crisis brought to the courts worldwide,especially to the U.S.courts.By contrast,so far there has been no such cases filed in Taiwan court.But in March,one information company claimed that the OPO tool software sold by the U.S.Oraclebone Corp.failed to deal with the leap year problem.It is worthy for our observance continuously.Therefore,this article tried to discuss several legal problems such as defect warranty liability,copyright protection and insurance etc.due to the Y2K crisis and figure out some resolutions thereof simultaneously.Finally,this article called for the joining efforts of the enterprise by well utilizing governmental assisting and favorable measures,to resolve the Y2K problem aggressively from the skill,management and legal aspects,to transform the crisis to a changing opportunity and to enhance its international competitiveness.
