人工智能生成物在著作权法中的定位——以ChatGPT为例

摘要 ChatGPT等人工智能生成物的著作权归属问题首先需要明确的是ChatGPT是否拥有法律主体资格;其次,ChatGPT本身是著作权的客体,ChatGPT生成物不能获得著作权保护,因为其不存在“创作”行为;最后,虽然ChatGPT生成物不具有可著作权性,但在其使用过程中存在侵犯原始数据权利人利益和扰乱社会竞争秩序的可能,为避免该生成物成为“无主物”,造成权利体系的混乱,应将其在著作权法中定位为ChatGPT著作权的附随物,该附随物上的权利不同于完整的作品权利,只有权利归属的宣示作用。 The copyright ownership issue of artificial intelligence products such as ChatGPT first needs to be clarified whether ChatGPT has the legal subject qualification.According to current legal regulations,all artificial intelligence models do not have the qualification to become legal subjects;Secondly,ChatGPT itself is the object of copyright,and the products of ChatGPT cannot obtain copyright protection because there is no"creative"behavior;Finally,although ChatGPT products do not have copyright ability,there is a possibility of infringing on the original data rights holder and social competition order during their use.To avoid confusion in the infringement system caused by the product becoming an"ownerless object",it should be designated as a subsidiary of ChatGPT copyright in copyright law.However,the rights on this subsidiary are different from the complete work rights,and only the declaration of the ownership of the rights plays a role.
