法治现代化进程下藏族习惯法的法律规制路径探析

Analysis of the Legal Regulation Path of Tibetan Customs in the Process of Modernization of the Rule of Law

藏族习惯法作为藏族社会传统法治文化的一部分,在藏族社会经济发展和社会稳定等方面具有重要作用,而其存在和发展也对国家法治现代化在民族地区的建设程度产生了一定程度的削弱,因此有必要对藏族习惯法进行法律规制。针对藏族习惯法在面临国家法治现代化建设时所面临的转型困境,应从加强民族立法、对民间调解机制的引导以及推进法治教育等层面,来加强对藏族习惯法的法律规制。

As part of the traditional rule of law culture of the Tibetan society,the Tibetan customary law plays an important role in the social and economic development and social stability of the Tibetan people.Its existence and development also weaken to a certain extent for the construction of the country's rule of law in ethnic regions.Therefore,It is necessary to regulate the Tibetan customs law.In response to the transformation dilemma faced by the Tibetan customs law when facing the modernization of national rule of law, it should strengthen legal regulations on Tibetan customs from the level of strengthening national legislation,the guidance of the civil mediation mechanism,and the promotion of the education of the rule of law.
