民法典视域下夫妻忠诚协议效力探析

An Analysis on the Effectiveness of the Marital Loyalty Agreement in the Perspective of Civil Code

忠诚协议为夫妻间自主签订的协议,其具有契约性、人身性和财产性。夫妻之间自主签订的忠诚协议是否具有法律效力的争议很大,各地法院判决不一,存在“有效说”“无效说”和“部分有效说”等观点。从尊重当事人意愿的角度,原则上应当承认夫妻忠诚协议的效力,并从法律层面去规范其生效要件,即其主体是否具有行为能力、意思表示是否真实一致和意思内容是否具体明确。同时,协议内容也不能违反法律和行政法规的强制性规定,且不得违背公序良俗。

The couple loyalty agreement is an agreement signed by the husband and wife,which is contractual quality,personality and property.There is a great dispute over whether the loyalty agreement signed between husband and wife has legal effect.The local courts have different judgments,and there are views such as"effective","invalid"and"partially effective".From the perspective of respecting the wishes of the parties,in principle,the validity of the marital loyalty agreement should be recognized,and the essential elements should be standardized at the legal level,that is,whether the subject has the capacity,whether the expression of intention is true and consistent,and whether the content of the meaning is specific and clear.At the same time,the content of the agreement shall not violate the mandatory provisions of laws and administrative regulations,and shall not violate the public order and good customs.
