帮助信息网络犯罪活动罪之探析——以宜春市2021年生效判决为分析样本

An Analysis of Crime of Assisting Information Network Crime:a Case Study of Effective Judgments of 2021 in Yichun City

以江西省宜春市2021年帮助信息网络犯罪活动罪生效判决为分析样本,从犯罪主体、犯罪主观方面、犯罪行为、罪名性质、刑罚适用对帮助信息网络犯罪活动罪司法适用进行分析。司法实践中对本罪的性质采取帮助犯的量刑规则,而非帮助行为正犯化,本罪的成立仍以主犯实施犯罪为前提,同时帮助他人实施本罪的帮助行为也将构成本罪。但在本罪的司法适用中也有对“帮助行为”“明知”进行扩张解释的嫌疑以及“情节严重”认定不统一的情形。针对以上情况,司法实践中应当严格遵循罪刑法定原则,不得随意扩张解释本罪的帮助行为的类型并统一认定“情节严重”的条件,从而真正做到公正司法,确保公民合法权益。

In this paper,the effective judgment of the crime of helping information network crime in Yichun City of Jiangxi Province in 2021 is taken as the analysis sample,and the judicial application of the crime of helping information network crime is analyzed from the aspects of criminal subject,subjective aspect of crime,criminal behavior,charge nature and penalty application.In judicial practice,the nature of the crime is to adopt the sentencing rules of assisting the crime,but not to help the behavior of the crime.The establishment of the crime is still based on the premise that the principal perpetrator commits the crime.At the same time,helping others to carry out the crime will also constitute the crime.However,in the judicial application of this crime,there are also the suspicion of expanding the interpretation of“helping behavior”and“knowing”as well as the situation that the identification of“serious circumstances”is not uniform.In view of the above situation,this paper holds that the judicial practice should strictly follow the principle of legal punishment,not arbitrarily expand the interpretation of the type of helping behavior and unified identification of“serious circumstances”conditions,so as to truly achieve justice,to ensure the legitimate rights and interests of citizens.
