摘要
自由区是一个国家或地区采取的“境内关外”的制度安排,也是一个国家法律意义上的“例外空间”。迪拜广泛的自由区体系促进了经济的转型发展,被认为是区域和全球自由区发展的典范。迪拜自由区通过法律、金融、税收、移民、监管等制度建设,不断提升其教育国际竞争力和开放程度,使其成为重要的区域性教育枢纽。同时,迪拜建立各具特色的教育自由区,吸引来自全球的高等教育机构,并为本土和国际学生提供与母校同质的多元课程。迪拜自由区教育对外开放的主要优势在于自由区作为“例外空间”为教育发展提供了差别监管的自由环境,完善的规则框架为教育开放提供了有力的制度保障,但其教育开放仍存在商业性与学术性、本地化与国际化等矛盾与挑战。迪拜自由区教育对外开放的经验教训可以为进一步深化中国特色自由贸易港和自由贸易试验区的制度设计、制度开放与制度创新提供启示和借鉴。
Free zone is an institutional arrangement of“inside national territory but outside customs”taken by a country or region,and it is also a“space of exception”in the sense of national law.Dubai's extensive free zones system has promoted the transformational development of the economy and is considered a model for regional and global free zone development.Through the construction of legal,financial,tax,immigration,regulatory and other systems in free zones,Dubai has continuously improved its international competitiveness and opening-up in education,making it an important regional education hub.Meanwhile,Dubai has established unique free zones in education,attracting higher education institutions from around the world,and providing local and international students with a diverse curriculum of the same quality as their original providers The main advantage of Dubai's opening-up of free zones in education is that free zone,as an "exception space",provides a free environment of differential supervision for the development of education,and the perfect rule framework provides a strong institutional guarantee for the opening-up of education,but there are still contradictions and challenges in the opening-up of education,such as commerciality and academic,localization and internationalization.The experience and lessons of Dubai's free zones in opening-up of education can provide inspiration and reference for further deepening the institutional design,institutional opening-up and institutional innovation of free trade ports and pilot free trade zones with Chinese characteristics.
