一、引言專利無效宣告程序(以下簡稱“無效宣告程序”)是一種雙方當事人參與的行政確權程序,在該程序中既可能發生專利權人的變更,也有可能發生無效宣告請求人的變更。在無效宣告程序中發生當事人變更時,是否需要中止以及重新聽證等程序問題的解決對于公正高效解決雙方當事人的爭議具有重要的意義。

The patent invalidity proceedings are an inter partes administrative patent review procedure,in which the change of patent owner or petitioner may occur.As for the change of party in invalidity proceedings,procedural issues such as whether suspension and re-hearing are necessary are of great significance to the fair and efficient resolution of the disputes between the parties.
