I.Introduction As far as a design patent is concerned,a product is the carrier of a design.The determination of the category of the product incorporating a patented design exists throughout every process concerning a design patent from the selection of product name at the time of application for design patent,to the classification of the patent application according to the International Classification for Industrial Designs in the patent grant procedure,and then to the judgments in the subsequent invalidity and infringement proceedings.
