试论我国职业教育法律制度

On the Legal System of Vocational Education in China

由于我国把发展职业教育作为重要的国家战略之一,职业教育近年来迅猛发展取得了辉煌成就。特别是随着修改后的《中华人民共和国职业教育法》在2022年5月1日的颁布实施,我国的职业教育法律制度日趋完善。本文在对职业教育的内涵、特征进行介绍,分析立法对职业教育的影响和促进保障作用的基础上,通过对我国职业教育法律制度立法的历史沿革、现状及特征的研究及对德国职业教育法律制度的借鉴,从法律体系、法律内容、法律责任、法律保障等方面分析我国职业教育法律制度。

As China takes the development of vocational education as one of the important national strategies,brilliant achievements have been made in recent years.Especially with the issuance and implementation of the re-vised Vocational Education Law of the People's Republic of China on May 1,2022,the legal system of vocational education in China has become more and more perfect.This article introduces the connotation and characteristics of vocational education,analyzes the influence and safeguard of legislation on vocational education.It also analyzes the legal system of vocational education from the perspective of legal system,legal content,legal liability and legal protection based on the historic evolution,study of the present situation and characteristics of the legislation of the vocational education legal system and reference to the vocational education legal system in Germany.
