《治安管理处罚法(草案)》中未成年人违法记录封存制度研究

Research on the Sealing System of Juvenile Illegal Records in the Law on Public Security Administration Punishments(Draft)

未成年人违法记录封存制度作为本次《治安管理处罚法(草案)》之中出现的新制度,对于我国的司法实践和罪错未成年人的保护制度均具有重要的意义。它是对刑事制度中未成年人犯罪记录封存制度在违法治理层面的继承与发展。因此对两种制度的现状与异同展开全面分析,在此前提下阐明违法记录被封存的必要性,对具体实施中将面临的范围程序之确立以及该制度的监管与衔接进行研究确有必要。

As a new regulation appeared in the Law on Public Security Administration Punishments(Draft),the sealing system of juvenile illegal records is of great significance to the legal practice and protection system for the minors who have committed offence.It is the inheritance and development of the juvenile criminal record seal-ing system of criminal system in the level of illegal management.Therefore,this paper will make a comprehensive analysis of the current situation and similarities and differences of the two systems,clarify the necessity of the seal-ing of illegal records,and study the establishment of the scope and procedures of the specific implementation as well as the supervision and connection of the system.
