Thoughts on the Integration of Chinese Excellent Traditional Legal Culture into the Construction of a Law-based Society

树高千尺有根,水流万里有源。我国是文明不曾中断过的文明古国,文化底蕴深厚,影响深远,我国的法治进程一直在向前推进,中华优秀传统法律文化丰富的特色基因影响着法治进程,靠实践经验走出了一条中国特色社会主义法治道路。党的二十大报告指出:“全面推进国家各方面工作法治化。”①法治社会建设是重要一环。于我国而言,建设法治社会必须扎根中国土壤,深挖本土法治资源,从传统法律文化中取其精华,试着从中华优秀传统法律文化的特色基因出发,分析其融入法治社会建设的可行性,寻找中华优秀传统法律文化融入法治社会建设的践行途径,继续在法治轨道上全面建设社会主义现代化国家。

Everything has its source.China is an ancient civilization that has never been interrupted,with profound cultural heritage and far-reaching influence.The process of rule of law in China has been moving for-ward.The rich characteristics of Chinese excellent traditional legal culture have influenced the process,and China has found a path of socialist rule of law with Chinese characteristics through practical experience.Report of the 20th National Congress of the Communist Party of China mentioned“promotes the legalization of various aspects of national work”.Building a society ruled by law is an important link.For China,the construction of a society ruled by law must take root in the soil of China,dig deep into the local legal resources,and take its essence from the traditional legal culture.We should try to start from the characteristic genes of Chinese excellent traditional le-gal culture,analyze the feasibility of its integration into the construction of the rule of law society,find the way of the practice of Chinese excellent traditional legal culture into the construction of the rule of law society,and contin-ue to build a modern socialist country in an all-round way on the track of the rule of law.
