检察机关“案-件比”案件质量评价体系运行探析

Exploring the Operation of the Case Quality Evaluation System of“Case Ratio”in Procuratorial Organs

在司法责任制配套改革和检察制度改革背景下,案件质量评价体系对于监督和规范检察权运行的作用日渐凸显。为解决既往案件质量评价体系之弊端,检察机关创新性地提出了以“案-件比”为核心的案件质量评价体系。相较过往案件质量评价体系,“案-件比”评价体系在引导检察工作精细化管理、兼顾公正与效率、彰显程序正义方面有着开拓性突破,对检察工作的规范化与检察管理的现代化具有正向引导作用。在知悉“案-件比”评价体系所面临的现实困境的基础上,为防止该体系的运行走向误区,可通过明晰“案-件比”指标差异、健全程序回转相关法律规定、提升检察业务水平、规范检察引导侦查,以及发挥捕诉一体与认罪认罚从宽制度优势等措施因情施策,以助力刑事案件质效的优化。

Under the background of supporting reforms of judicial responsibility system and procuratorial system reform,the role of case quality evaluation system in supervising and standardizing the operation of procuratorial power has become increasingly prominent.In order to avoid the shortcomings of previous case quality evaluation systems,the procuratorial organs have innovatively proposed the case-ratio-centered case quality evaluation system.Compared with previous case quality evaluation systems,the“case ratio”evaluation system has made pioneering breakthroughs in guiding refined management of procuratorial work,balancing fairness and efficiency,and highlighting procedural justice,which has a positive guiding effect on the standardization of procuratorial work and the modernization of procuratorial management.With knowledge of practical dilemma faced by the“case ratio”system,in order to prevent the system from going off the right track in practice,it is proposed to take such circumstance-specific measures as clarifying differences among“case ratio”indicators,improving relevant legal provisions concerning procedure reversal,improving the level of procuratorial operations,standardizing procuratorial guiding investigation,and bringing the advantages of the integration of arrest and prosecution and the plea leniency system into play,so as to help optimize the quality and effectiveness of criminal cases.
