学界对奥斯丁及其法哲学思想的反思、批判一直没有停止。在当下特定时空,应就对奥斯丁的上述既有批判进行反思与剖析,从中梳理出其背后所共享的思维方式和方法论基础,以对奥斯丁的法哲学核心范畴及其理论体系做更为精准的理解和把握,在此基础上重新认识“法律是主权者的命令”这一命题,并进一步思考奥斯丁的法哲学能给当下构建中国自主法理体系、法学体系及中国式法治现代化带来的启示意义。

The academic reflection and criticism of Austin and his philosophy of law have never stopped.In the current context,it is necessary to reflect on and analyze the above existing criticism of Austin and identify the underlying shared modes of thought and methodological foundations,thereby gaining a more precise understanding and grasp of the core category and theoretical system of Austin's philosophy of law,and on this basis,re-understand the proposition that“law is the command of the sovereign”,and further explore the implications of Austin's philosophy of law for the construction of an independent Chinese jurisprudence,legal system,and the modernization of rule of law with Chinese characteristics.
