论数字化时代毒品问题的高效能治理

The Efficient Drug Governance in the Digital Age

毒品犯罪网络化的特点愈发突出,这是数字化时代技术进步在犯罪领域的自然响应,但当前毒品治理仍沿用传统“面向物理空间”的介入模式,已无法适应数字化时代毒品犯罪的发展演变特性。厘清“数字化—高效能”耦合机理,寻求毒品问题高效能治理的实现路径,是我国毒品违法犯罪治理在当前时代背景下的应有之义。以“网络空间系统性治理”为主要途径、“技术与制度互嵌运行”为主体框架,“多中心协同治理”为基本方法,是实现这一目标的内在逻辑。具体来看,应当强化动态、开放、多维的禁毒理念,破除传统单向治理模式;推进禁毒技术手段创新发展,提高治理效率;完善禁毒制度,实现对技术发展的促进和规制的“二元目标”;优化多元禁毒主体协同共治模式,激活治理效能提升的内生动力;构建数字化禁毒效能评价长效机制,增强治理效能提升的外生动力。

In the digital era,the network characteristics of drug crimes are becoming increasingly prominent.However,traditional"physical space-oriented"intervention model cannot effectively respond to their evolutional characteristics.Thus,it is necessary to establish the dual mechanism of drug problem.To this end,"systematic governance of cyberspace"is taken as a main approach,"interlocking operation of technology and system"serves as a main framework,and"multi-center collaborative governance"as the basic method.Specifically,we should establish the concept of dynamic,open and multi-dimensional drug control,not confined to the traditional one-way governance model.Anti-drug technology and means should be improved for the governance efficiency.The digital drug control system should be bettered to achieve the"dual goal"of effectively promoting and regulating technological development.The cooperative and co-governance mode of multi-drug control should be optimized to activate the endogenous driving force in governance.A long-term mechanism should be built for digital drug control effectiveness evaluation to enhance the exogenous driving force.
