民间文学艺术作品版权保护中的想象、真相与走向

摘要 民间文学艺术作品保护的单行立法至今未出台,这是由民间文学艺术本身的特质所决定的。我国理论研究和司法实践的落差表明,民间文学艺术作品的保护应当回归到私法的框架之下。需要厘清民间文学艺术作品本身和民间文学艺术衍生作品,后者是对前者的演绎作品,前者不需要采用设权模式加以保护,后者则可以通过赋权给演绎个体的方式激励后续创作和利用。对于演绎过程中的歪曲、篡改行为,可以考虑在《著作权法》中引入公序良俗原则进行规制。民间文学艺术衍生作品的创作与传播应当尊重市场逻辑。 The separate legislation on the protection of works of folklore has not been introduced so far,which is determined by the characteristics of folklore itself.The great contrast between theoretical research and judicial practice in our country shows that the protection of works of folklore should return to the framework of private law.To solve the problem,it is necessary to clarify the works of folklore itself and the derivative works of folklore.The latter is the derivative works of the former,and the former does not need to be protected by the mode of establishment of rights,while the latter can stimulate the subsequent creation and utilization by empowering the derivative individuals.For the distortion and tampering in the process of derivation,we can consider introducing the principle of public order and good custom into the Copyright Law to regulate.The creation and dissemination of derivative works of folklore should respect the market logic.
