NFT数字作品是NFT技术与数字作品融合链接的产物。未经许可上传并铸造NFT数字作品侵害著作权人的复制权和信息网络传播权,鉴于侵权复制件的价值较低,其损害赔偿责任可以被信息网络传播权侵权责任吸收。NFT数字作品的交易没有导致作品载体所有权的转移,不构成发行行为,亦不能适用“发行权用尽”原则。NFT数字作品交易平台不仅需要承担一般网络服务提供者的责任,还需要承担较高的注意义务,其责任边界可依据“一般可能性”标准认定。

NFT digital works are the products of the fusion link of NFT technology and digital works.Uploading and casting NFT digital works without permission infringes the copyright owner’s right to copy and the right to disseminate information on the Internet.In view of the low value of the infringing copy,its liability for damages can be absorbed by the infringement liability of the right to disseminate information on the Internet.The transaction of NFT digital works does not lead to the transfer of the ownership of the carrier of the works and constitute an issuing act,nor can it apply the principle of“exhaustion of issuing rights”.The NFT digital works trading platform not only needs to assume the responsibility of the general network service provider,but also needs to assume high attention obligations,and its responsibility boundary can be determined in accordance with the“general possibility”standard.
